Oh yeah, Hermione can't push Harry to take the initiative on buying Gabrielle, because she hasn't heard or thought of that idea yet, she wasn't with them. Ok, but why is Susan, Ms. Politics/Law, not at least offering that suggestion? That's her job, isn't it? After all, none of the girls believe their defense against Malfoy can succeed.
Though I have to wonder why none of them are suggesting using Gabrielle's memory of the note and Draco's actions to prove the rape charge. Harry has only been spending evenings with Dumbolddork looking at memories in a penseive.

You have picked up on the Hermione point of not knowing, for Susan the whole group was focuses in not buying Gabrielle. Harry did not want to and they thought that there case was strong enough to let them win. Turning to a friend and saying oh well you are no longer a person you are now a creature is a very big step, and one none of them wanted to even consider after Harry had said no. Luna just says things she cannot see the hurt good or bad that her words create, that is they only reason that they knew about the possibility. So they didn’t want to start any bidding war. Also it would have been unlikely at this point that Gabrielle parents would have sold Gabrielle they would have just pulled her away, the whole purchases was a thought giving by Luna and a plan created by Gabrielle on her own, but I do see your points.
Pensive memories. Is a good point but I look at them and veratisum as the same, they could not / not allowable in this situation. If all crimes used such methods for determining truth then why didn’t Sirius use it as his defence or the Ministry in any of their other trials? I look as both of them as useful but not infallible and so forth unusable in a legal setting, they are tools but that is all. They may be used in the later investigation but we will have to wait and see.
